• Payment & Transaction Details: Credit/debit card numbers, billing addresses, and transaction histories processed securely through our integrated third-party payment and booking software vendors.
• Health & Fitness Information: Disclosed physical conditions, medical background, injury history, pregnancy status, heat sensitivity, and workout goals submitted voluntarily to ensure safe participation during mat Pilates, heated sessions, and studio activities.
• Automated Site Data: IP address, device specifications, browser type, operating system, and online activity collected automatically via standard browser cookies, analytics tools, or advertising pixels (e.g., Google or Meta tools, if active) when interacting with our website.

2. How We Use Your Information
We use your personal data for business, operational, and marketing purposes, including:
• Service Delivery & Bookings: Creating client accounts, managing Early Access registrations, processing class reservations, managing schedules, and handling membership billing.
• Instructional & Studio Customization: Adapting exercise modifications, prop usage, and accommodating disclosed health conditions or environmental sensitivities (such as heated studio settings).
• Electronic Marketing: Sending newsletters, studio announcements, promotional offers, booking confirmations, and reminders via email and SMS.

3. Data Sharing & Third-Party Disclosures

Welcome to Lux Sculpt. By utilizing our website, booking software, studio services, or electronic communication programs, you agree to comply with and be bound by the following Terms and Conditions.

1. Class Bookings, Memberships & Cancellations
• Eligibility: Participants must be at least 18 years of age (or have written parent/legal guardian consent).
• Memberships are personal, non-transferable, and non-assignable.
• Recurring Billing & Autopay: All recurring membership tiers (including Founding rates) are automatically billed on a monthly recurring basis to the card on file. Unused classes do not roll over into subsequent billing cycles.
• Facility & Hygiene Rules: Members must adhere to studio hygiene standards, care for all studio props, and maintain a respectful environment. Misconduct may result in membership revocation.
• Priority booking:
◦ Founding Essential & Signature Memberships: Priority booking 1 day class booking before non-members.
◦ Founding Unlimited Memberships: Priority booking 7 days class booking before non-members.
• Commitment Terms:
◦ Founding Essential & Signature Memberships: Require a minimum 12-month commitment. The rates are locked for the initial 12 months from enrollment.
◦ Founding Unlimited Membership: Requires a minimum 12-month commitment. The rate is locked for life, provided the membership remains continuously active, current, and in good standing.
• All Founding Memberships can enjoy 10% off Lux Sculpt retail purchases for 12 months from the date of membership activation.
• Cancellation Window & Late Fees: Class reservations must be cancelled at least 12 hours before the scheduled class start time to avoid a late-cancellation penalty:
◦ Limited Monthly Memberships & Class Packages: Late cancellations or no-shows will forfeit the class credit.
◦ Unlimited Members: A $15 will be charged for late cancellations within the 12-hour window, and a $25 fee will be charged for no-shows.
◦ Single Classes, Introductory Offers & Guest Passes: These will be forfeited if cancelled within the 12-hour window or in the event of a no-show.

2. The Founding 50 Terms & Conditions
The first 50 clients who complete enrollment in the Founding Unlimited tier receive special benefits governed by the following rules:
• Lifetime Rate Guarantee: The monthly Founding Unlimited rate is locked for life, provided the membership remains continuously active, current, and in good standing.
• Scope of Guarantee: The protected lifetime rate applies strictly to base monthly membership dues. It does not apply to taxes, late cancellation/no-show fees, retail purchases, or additional studio services.
• Additional Perks: Founding 50 members receive 10% off eligible Lux Sculpt retail, priority booking access before public launch, and one (1) complimentary guest pass per monthly billing cycle. Guest passes expire at the end of each cycle and do not roll over.
• Cancellation & Re-enrollment: If a Founding 50 membership is canceled for any reason and the client later re-enrolls, the locked rate is permanently forfeited, and the client must pay the current published market rate.
• Freeze Policy: Founding Unlimited memberships may be frozen up to two (2) times per calendar year, for a maximum of 30 consecutive days per freeze, without forfeiting the lifetime rate guarantee. Extended medical freezes may be considered on a case-by-case basis with appropriate medical documentation.

3. Modalities, Props & Wellness Disclaimer
Lux Sculpt provides mat-based offerings including mat Pilates, sculpt, strength, cardio sculpt, yoga, infrared heat modalities, and red light therapy.
• Wellness Disclaimer: Lux Sculpt services, including Infrared Heat and Red Light Therapy, are intended solely for general wellness, relaxation, and physical conditioning. They are not intended to diagnose, treat, cure, or prevent any medical condition, disease, or physical ailment. You should consult a qualified physician regarding any medical concerns before participating.
• Physical Exertion & Props: Sessions utilize bodyweight, mat movement, and light props (e.g., bands, light weights, blocks). You voluntarily assume all risks associated with physical exertion.
• Environmental Conditions: Sessions may involve elevated temperatures via infrared heating units. You are responsible for staying hydrated and stopping participation if you experience lightheadedness or discomfort.
• Liability Release: Before participating in any physical session, you must complete a standalone digital or physical Liability Waiver & Release Form during account setup.

4. SMS & Electronic Marketing Program
By signing up for communications, booking services, or submitting online forms, you may choose to opt in to our electronic communications.
• Affirmative SMS Opt-In: Providing your phone number for transaction processing, booking, or account registration does not automatically enroll you in marketing text messages. You must explicitly opt in (via an un-checked consent checkbox or direct written submission) to receive promotional text messages.
• Program Overview: SMS updates include schedule updates, waitlist alerts, class reminders, studio announcements, and promotional offers (2–6 messages per week).
• Costs & Opt-Out: Message and data rates may apply. Reply STOP to any text message to opt out immediately. Reply HELP for customer support. Unsubscribe links are available in all promotional email footers.

5. Modifications & Governing Law
Lux Sculpt reserves the right to modify these Terms and Conditions at any time. Updated terms take effect immediately upon publication. These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey. Any legal action arising under these terms must be brought exclusively in the state or federal courts located in New Jersey.
